TERMS AND CONDITIONS - NIGHT MOVES FEST TICKET PURCHASE
These Terms and Conditions ("Agreement") govern the purchase of tickets to attend Night Moves Fest ("Festival") through the third-party ticketing platform TicketSilver. By purchasing tickets through TicketSilver for Night Moves Fest, you ("Purchaser" or "Ticket Holder") agree to be bound by these terms and conditions. TicketSilver is a service that provides you with tickets to events. TicketSilver does not operate these events and cannot control unforeseen circumstances which may occur at an event. Please read the following Terms and Conditions carefully as it represents an agreement between yourself and TicketSilver. 1. Ticket Purchase
1.1 Ticket Availability: Tickets for Night Moves Fest are subject to availability and may be sold on a first-come, first-served basis. TicketSilver does not guarantee ticket availability. TicketSilver sells tickets on behalf of Event Promoter/Producer, which means we do not set ticket prices or determine availability. Tickets for popular events may sell out quickly. Occasionally, additional tickets may become available prior to the event. However, TicketSilver does not control this inventory or availability. When ordering tickets online with TicketSilver, please ensure you are looking for tickets and placing an order using only one browser window or tab. Looking up tickets using multiple browser windows or tabs could result in losing your tickets, timer expiration, purchasing too many tickets, or the wrong ticket type, none of which will be the responsibility of TicketSilver. Please ensure that you read all the information that applies to the event/ticket you are booking, and carry proof of identity and age when attending the event. Customers are advised to carefully review each order to ensure that the purchaser has selected the correct event and ticket type. If the purchaser does not receive a confirmation (in the form of a confirmation page or email) after submitting payment information, or if the customer experiences an error message or service interruption after submitting payment information, it is the customer’s responsibility to confirm with TicketSilver whether or not the order has been placed. TicketSilver will not be responsible for losses (monetary or otherwise) if the customer fails to confirm the purchase. It is the responsibility of the customer to inform TicketSilver of any change of address, contact phone number or email address, both before and after receipt of the ticket(s). Please note that our preferred method of contact for customers booking online is by email, so care should be taken to provide a current, valid email address.
1.2 Pricing: Ticket prices are determined by Night Moves Fest organizers and are subject to change without notice. TicketSilver may charge service fees in addition to the ticket price. Please check your order details carefully before checking out. Any service fees for the payment plan will appear in the total. In some cases, TicketSilver or other distribution channels may receive additional, subsequent allocations of tickets for distribution, which may be of similar or higher desirability than those sold on TicketSilver, or may be offered for sale at lower prices than prices charged on TicketSilver.
1.3 Age Restrictions: Some events within the Festival may have age restrictions. It is the responsibility of the Ticket Holder to verify age requirements before purchasing tickets. No refunds will be issued for underage attendees.
2. Ticket Delivery
2.1 E-Tickets: Tickets purchased through TicketSilver may be delivered electronically as e-tickets. Ticket Holders are responsible for printing or displaying e-tickets on a mobile device for entry.
2.2 Delivery Delays: TicketSilver and Night Moves Fest organizers are not responsible for delays in ticket delivery due to technical issues, email filtering, or other factors beyond their control.
3. Refunds and Exchanges
3.1 Refund Policy: Once purchased, tickets cannot be refunded unless the event is cancelled. If the event has been canceled or postponed, you may be entitled to a face value plus tax refund (if tax was charged), subject to the event producer’s refund policy. All fees (booking, service, transaction, processing, shipping, fulfillment, etc.) are non-refundable. It is the customer’s responsibility to check whether the event is proceeding on the scheduled date, time, and venue. TicketSilver cannot guarantee that Promoter/Producer will inform the customer of any changes to the event date, time, venue, or talent. Refunds for cancelled or postponed events are not automatically processed. Within five days of the scheduled event date, you must email your order information to email@example.com to request your refund. In the event that Promoter/Producer fails to honor a refund that a customer believes is due under the applicable refund policy, that customer may request that TicketSilver review the facts and circumstances and determine whether or not a refund is due in accordance with the applicable refund policy. TicketSilver will endeavor to complete its review within thirty (30) days of being contacted by customer. Customer should note that if a Promoter/Producer has selected a facilitated payment method such as Stripe for an event, TicketSilver will not have control of the funds and TicketSilver will need the Promoter/Producer and the provider of the facilitated payment method to cooperate in order to obtain a refund, which may not happen. All determinations of TicketSilver with respect to these Customer Refund Policy Requirements, including without limitation the orders to be refunded and the size of any refund, shall be final and binding on customer. Please note, in the event of an event being cancelled or postponed, neither TicketSilver nor Night Moves Fest can be held responsible for any costs incurred by the customer for travel, accommodation, or any other related service.
3.2 Event Changes: Night Moves Fest organizers reserve the right to change the event schedule, lineup, or venue without prior notice. No refunds or exchanges will be offered due to such changes.
4. Entry and Security
4.1 Valid ID: Ticket Holders will be required to present valid government-issued photo identification for entry. Failure to provide valid ID may result in denied entry without a refund.
4.2 Security Screening: Ticket Holders are subject to security screening upon entry. Illegal and/or otherwise prohibited items may be confiscated, and individuals in possession of prohibited items may be denied entry or removed from the Festival without a refund. The right to admission to the event is reserved by the promoter and event venue, who may take health, safety, environmental, and security concerns into account at their reasonable discretion, and may from time to time carry out security searches. No refunds will be offered to those who are refused entry or ejected from the venue on account of: being (or appearing to be) under age as specified by the event organizer; declining to be searched; abusive, threatening, drunken, or other antisocial behavior (including smoking in no smoking areas); carrying offensive weapons or illegal substances; or making any type of unauthorized audio, video, or photographic recordings.
5.1 Code of Conduct: Ticket Holders are expected to follow all rules and regulations set forth herein and by Night Moves Fest organizers. Disruptive or unlawful behavior may result in ejection from the Festival without a refund.
6.1 Assumption of Risk: Ticket Holders acknowledge that attending the event involves inherent risks, including but not limited to injury or illness. Ticket Holders voluntarily assume all risks and liabilities associated with attending the event.
6.2 Limitation of Liability: Night Moves Fest organizers, TicketSilver, and their affiliates shall not be liable for any loss, injury, or damage incurred by Ticket Holders while attending the event, except where such liability cannot be excluded by law.
8.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Florida, without regard to its conflict of law principles.
8.2 Amendment: Night Moves Fest organizers and TicketSilver reserve the right to amend these terms and conditions at any time. Any changes will be posted on the Festival's website.
8.3 Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8.4 By purchasing tickets to Night Moves Fest through TicketSilver, Ticket Holders acknowledge that they have read, understood, and agreed to these Terms and Conditions. Failure to comply with these terms may result in denied entry or ejection from the Festival without a refund.
What information do we collect?
We collect information from you when you register on the site, place an order, enter a contest or sweepstakes, respond to a survey or communication such as e-mail, or participate in another site feature. When ordering or registering, we may ask you for your name, e-mail address, mailing address, phone number, credit card information or other information. You may, however, visit our site anonymously. We also collect information about gift recipients so that we can fulfill the gift purchase. The information we collect about gift recipients is not used for marketing purposes. Like many websites, we use “cookies” to enhance your experience and gather information about visitors and visits to our websites. Please refer to the “Do we use ‘cookies’?” section below for information about cookies and how we use them.
How do we use your information?
We may use the information we collect from you when you register, purchase products, enter a contest or promotion, respond to a survey or marketing communication, surf the website, or use certain other site features in the following ways:
- To personalize your site experience and to allow us to deliver the type of content and product offerings in which you are most interested.
- To allow us to better service you in responding to your customer service requests.
- To quickly process your transactions.
- To administer a contest, promotion, survey or other site feature.
If you have opted-in to receive our e-mail newsletter, we may send you periodic e-mails. If you would no longer like to receive promotional e-mail from us, please refer to the “How can you opt-out, remove or modify information you have provided to us?” section below. If you have not opted-in to receive e-mail newsletters, you will not receive these e-mails. Visitors who register or participate in other site features such as marketing programs and ‘members-only’ content will be given a choice whether they would like to be on our e-mail list and receive e-mail communications from us.
How do we protect visitor information?
We implement a variety of security measures to maintain the safety of your personal information. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. When you place orders or access your personal information, we offer the use of a secure server. All sensitive/credit information you supply is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our databases to be only accessed as stated above.
Do we use “cookies”?
We may contract with third-party service providers to assist us in better understanding our site visitors. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.
You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser (like Netscape Navigator or Internet Explorer) settings. Each browser is a little different, so look at your browser Help menu to learn the correct way to modify your cookies. If you turn cookies off, you won’t have access to many features that make your site experience more efficient and some of our services will not function properly. However, you can still place orders over the telephone by contacting customer service.
Do we disclose the information we collect to outside parties?
We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information unless we provide you with advance notice, except as described below. It does not include website hosting partners and other parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property, or safety.

In an attempt to provide you with increased value, we may include third party links on our site. These linked sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these linked sites (including if a specific link does not work).
